BirdBeat is a free groovebox that runs in your browser. It's offered by HAINZ (full details in the legal notice). These terms apply whenever you use BirdBeat.

Features may change, move or disappear, and sometimes things will break. We work hard to keep BirdBeat running. Because it's free, there's no right to a particular feature or to availability at all times.

Everything you make is stored in your browser, not with us. Great for privacy, terrible for people who skip backups. Your browser or device may delete stored data, for example when storage runs low or you clear site data. Save a backup now and then under YOUR DATA. We can't restore what we never had.

What you create with BirdBeat belongs to you. We claim no rights to it. The built-in sounds are our own, synthesized right in the browser. Use them in your tracks however you like, commercial releases included, free of charge.

The BirdBeat software, design and texts are protected by copyright. You may use the app as provided on this website. Copying, modifying, redistributing or hosting the software or parts of it needs our prior written permission. The built-in sounds are the exception, see section 4.

Only record what you're allowed to record.

• Recording other people's private conversations without their OK is a crime in Germany (§ 201 StGB) and rude everywhere. Ask first.
• If you publish a recording with other people's voices in it, you are responsible for it, including under data protection law.
• Music, films and other works belong to someone. Only record, import or sample them if you have the rights or the law allows it.

You're responsible for what you record, import and share with BirdBeat.

Don't use BirdBeat to break the law, and don't attack or overload our server. Found a security hole? Please tell us via /.well-known/security.txt. We'll be grateful, not grumpy.

BirdBeat is made for people aged 16 and up. Younger than that? Please get a parent's OK first.

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.

For slight negligence, we are liable only if we breach an essential obligation. That is an obligation that makes using BirdBeat possible in the first place and on which you may regularly rely. In that case our liability is limited to the typical, foreseeable damage. Otherwise we are not liable for slight negligence.

If data is lost through slight negligence, we are liable only for the effort it would take to restore it from a regular backup.

Mandatory consumer law stays untouched.

We may update these terms, for example when BirdBeat gets new features. The version on this page at the time you use BirdBeat applies. Big changes get a note in the app.

German law applies. If you are a consumer living in another country, you keep the protection of that country's mandatory law.
